Zeman má analýzu, podle níž neexistuje právní překážka ke jmenování předsedy ÚS

Prezident Miloš Zeman disponuje analýzou, podle níž neexistuje právní překážka pro to, aby ještě před vypršením svého mandátu jmenoval nástupce Pavla Rychetského v čele Ústavního soudu (ÚS). Tomu funkční období skončí až v srpnu. V pořadu Prezidentský Press klub zveřejněném na webu rádia Frekvence 1 Zeman také uvedl, že jmenování jednoho ze čtyř rektorů z tohoto týdne nabude platnosti až k 18. březnu, tedy potom, co už nebude prezidentem. Zda krok, který ovlivní chod Ústavního soudu, učiní, nechce Zeman prozradit do voleb nové hlavy státu.

»Čekal jsem, že nějaký právní purista se ozve, nikdo se neozval,« komentoval Zeman středeční jmenování rektorů. Do roku 2027 mají vést Ostravskou univerzitu (OU) Petr Kopecký, Slezskou univerzitu v Opavě (SU) Tomáš Gongol a Univerzitu Jana Evangelisty Purkyně v Ústí nad Labem (UJEP) Jaroslav Koutský. V čele škol nahradí nynější rektory, kteří univerzity vedli dvě po sobě jdoucí čtyřletá období, a znovu proto kandidovat nemohli. Ve funkci rektora Vysoké školy uměleckoprůmyslové v Praze (UMPRUM) bude pokračovat Jindřich Vybíral. Kandidáty v závěru loňského roku zvolily akademické senáty vysokých škol.

Snaha jmenovat nového předsedu ÚS několik měsíců před tím, než skončí ten současný, by mohla destabilizovat českou justici, tvrdí ale třeba ústavní právník Jaroslav Benák. Zeman se v nedávném rozhovoru pro CNN Prima News odvolával na konzultace s »vedoucími představiteli české justice«. Dnes Zeman uvedl, že už má k dispozici právní analýzu. Kdo za ní ale stojí, neřekl. Na dotaz, zda prezident krok do konce svého mandátu učiní, Zeman uvedl, že je třeba vyčkat. »Nechtěl bych, aby se téma stalo tématem prezidentský voleb, je to téma okrajové,« uvedl s odkazem na ekonomickou situaci či válku na Ukrajině. Někteří kandidáti by toho podle něj využili v kampani.
